Federal labor law does not preempt defendant-City from requiring
parties receiving tax increment financing to sign a labor neutrality
agreement.

DEHART v. HORN (11/16/04 - No. 03-4250)
Dismissal of plaintiff-prisoner's claim under the Religious Land Use
and Institutionalized Persons Act, alleging a failure to provide him
with a diet comporting with his Buddhist belief, is reversed where
plaintiff has satisfied the exhaustion requirement of 42 U.S.C. section
1997e(a) and may proceed with his claim.

In a wrongful discharge suit, the district court did not err by
remanding the case to state court since the claims were not preempted by
operation of Section 301 of the Labor Management Relations Act.

Parents have a constitutionally protected liberty interest in raising
and directing the education of their children and a state employer
cannot condition employment upon the waiver of that right.
