Denial of plaintiff's motion for a new trial is affirmed where the
district court did not abuse its discretion since the jury's verdict was
not "ineluctably inconsistent" and the record does not support
plaintiff's contention that the special verdict form inaccurately
transmitted the jury's verdict.

DLX, INC. v. COMMONWEALTH OF KENTUCKY (08/26/04 - No. 03-5528)

Dismissal of plaintiff's claim, alleging that denial of a permit to
mine constituted a regulatory taking of property in violation of the
Fifth Amendment, is affirmed where the Eleventh Amendment bars
plaintiff's claims against defendant-Kentucky in federal court.

The district court's entry of a permanent injunction barring the
Minnesota Public Utilities Commission (MPUC) from requiring plaintiff to
provide defendant with reports regarding the provision of certain
telecommunication services is reversed where the FCC has not preempted
the authority of the MPUC in this area.

DILLON v. BROWN COUNTY (08/23/04 - No. 03-3687)
In a civil rights lawsuit arising out of a motor vehicle accident,
plaintiff's allegations of gross negligence are insufficient to satisfy
a claim of substantive due process where the plaintiff failed to show an
intent to harm required to establish a violation of substantive due
process.

Dismissal of plaintiff's products liability action against paint
producers is reversed with respect to defendants-LHB Industries, Hill
Manufacturing, and Sherwin Williams, where each defendant had sufficient
contacts with the state for exercise of personal jurisdiction.

The prayers at a school district's mandatory meetings and in-service

Plaintiff's challenge to a state law requiring it to maintain railroad

preempts state administrative proceedings commenced by a state agency.

District court's denial of summary judgment on the basis of qualified
immunity is reversed where the evidence was insufficient to support a

REPUBLICAN PARTY OF MINNESOTTA v. KLOBUCHAR (08/26/04 - No. 03-2801)
Plaintiff's challenge to a state statute, under which he was charged
with making a false campaign statement, is dismissed where plaintiff's
as-applied challenges are moot following dismissal of the charges and
the First Amendment facial overbreadth challenge is dismissed for lack
of standing.

REVELS v. VINCENZ (08/27/04 - No. 03-2429)
Grant of summary judgment to defendant-prison officials is affirmed
where deprivation from the use of a toilet for a few seconds does not
rise to a constitutional violation and plaintiff did not show that he
was denied privileges in retaliation for filings grievances against
defendants.

The district court's finding, that a French court's orders against

defendants, as the defendant did nothing wrongful in bringing the suit

QWEST CORP. v. CITY OF SANTA FE (08/25/04 - No. 02-2258, 02-2269)
In a challenge to defendant-City's ordinance, which established
procedures for telecommunications providers seeking access to city-owned
rights-of-way, certain preempted provisions are severable, and the
remaining ordinance sections are not disturbed by the removal of the
invalid provisions.

TANDY v. CITY OF WICHITA (08/26/04 - No. 02-3329, 02-3340)
Dismissal of plaintiffs' suit, alleging violations of the
Rehabilitation Act and the Americans with Disabilities Act, is reversed
where the district court erred by analyzing plaintiffs' standing in
gross, instead of individually in relation to each claim for relief.
